I am not a "frequent flier" but I did just fly twice in the last month, and thru a major California Airport to boot, and have flown a few other times since 9-11. In addition, I also looked up the regs regarding in flight scanners. 
 
I had no problem getting the R2 thru airport security, and no turned heads from listening to it at the airport while waiting for the flight. For both flights I put it thru the Xray machine inside my checked baggage. On previous flights I have been asked to demostrate that it worked, but that's all. I actually got more hassle over a PS2 that I carried along to watch DVD's at the hotel - they did a full Gas Chromo sweep of it for signs of explosives!
 
So far as the scanner in flight goes, you have a whole 'nother ball of wax, there. Since it is a bonafide RF device (even tho a reciever it still 'transmits' IF and RF mix frequencies) and so falls under the same guidelines as a cellphone. It is not legal to have on except while the plane is on the ground. If you are caught listening to it and they realize what it is, they will as a minimum kill your fun, and technically can charge you with endangering the aircraft, since it could feasibly affect navigation instruments. Not a good idea. 
 
Other than the in-flight clincher, tho, have fun - I take mine, programmed with all the current freqs for airports and Pub Svc channels for both ends, it helps kill the time while waiting for those delayed flights.
