Yes, you’re right. There seem to be two prevalent schools of thought on burning CD (audio and data), both of which are usually wrong from a quality/errors standpoint:
1. Burn at the fastest possible speed that the drive/media/software combo permits.
2. Burn at the slowest possible speed that the drive/media/software combo permits.
But even when you burn with the best media for your drive at the best possible speed, it’s still far less likely to be read error-free on some other drive than is a commercial, undamaged CD.

I agree that there is no moral problem with doing that, but it’s still copyright infringement; you don’t have the right to distribute copies even to people who purchased the same CD. I know that I am arguing technicalities here, realizing that no one would ever be prosecuted in such a scenario.
