I'm relatively new to the world of IBM software licensing T's&C's,
but that looks business-as-usual to me for their non-warranted stuff.

And, depending on how you read the "and", It may be that downloading is
fine (such as downloading for eventual transfer to the big box), but under
condition "2", downloading AND using it on the 2nd machine is not OK.
