Ron,

Somehow I just cannot see IBM giving Hercules enthusiasts rights to its all=
eged IP while at the same time paying royalties to Microsoft (or whoever th=
e investor is) for Hercules inventions.

And if the Hercules invention really does turn out to be so valuable that M=
icrosoft can still make a profit out of it after paying millions in legal e=
xpenses for the patent litigation, why would the inventor want to go throug=
h all that bother just to line the pockets of Microsoft and the lawyers?

A colleague has suggested that a Hercules Technical Disclosure Bulletin, al=
ong the lines of=20
http://en.wikipedia.org/wiki/IBM_Technical_Disclosure_Bulletin
might be a more achievable goal, the goal being to try and prevent IBM from=
 obtaining further patents which they could use against Hercules in the fut=
ure.
