Those are appealling thoughts. But the issue of copyright goes beyond published and distributed matter. Which is the difficulty in your idea. 

I think rather than the term 'copyright', it is the confusion over what the digital medium is and is not that causes difficulties in interpretting laws written before it existed. Unresolved, and I alluded in another post to the problem of the wide variety and nature of different ebook file formats, is how to exactly interpret what a digital single copy is. I don't see how, in view of the fact there is a growing concensus - or perhaps acceptance - that some inclusivity needs to be defined and legalised, a reasonable answer to that aspect can be long delayed.

It probably needs a throrough and careful review to decide how, and whether, file types can be grouped. Since a .txt file can be used anywhere [almost], it is the unusual one! The pdf, which is probably still the most used, is potentially the most complex, and therefore the least candidate for being included with any other file format in a group. 

Probably the biggest confusion at this point is using the term 'ebook' as though it was a single type of format, rather that itself describing the technology which is capable of devising infinite variation.
