Another aspect of the 3650 FCC ruling is that this makes use of part of
Cognitive Radio efforts goals" 'Listen before Talk'.  The 802.22 Cognitive
Radio standard and future implementations within 802.16 will potentially
cover wide areas of spectrum, often with overlapping regulatory provisions,
such as in UHF bands.  This narrow use of listen before talk principle can
make use of more sensitive RF section of radios and OFDMA's finer grained
channel scheme to more adroitly get out of the way of  licensed FSS
satellite earth stations now resident in the band.

The longer term vision for use of cognitive radio methods calls for the FCC
to loosen spectrum to multiple uses based on smart/cognitive radios ability
to stay out of the way of existing, but often very limited geographic use of
spectrum.  In this case where legacy satellite-earth communications must be
protected, the localized use is quite limited.  And due to the PtP nature of
the antenna earth stations, interference can be avoided.  In other
spectrums, such as hospital/medical equipment applications, the abilities of
C.R. will likely take a protracted time frame to prove itself worthy of
cohabitation.  Some methods, such as broadcast beacon signals around
hospital zones has been suggested.  But even that may not be a sufficient
argument for early trials of C.R.  In the meantime there are safer bets in
UHF and other spectrum for peaceful coexistence with legacy bandwidth hogs.
