You did not read my initial "heads up" post? No problem, I will say it
again, and in other words:

The ZACR (and you) are wrong. and here is why:

You (and the ZACR) are banking on the registry emails reaching a domain
registrant.

When the registry fails to send an update via email (as in this
specific example) and in other cases where the registrant email address

For your information - the @gmail.com account, in the specific example-
did not receive any update tickets (for whatever reason) and the
Registrant - effectively - had NO CONTROL - (neither did the gaining
registrar)

The "losing" registrar has been paid their fee - Also see the Consumer
Act i.e - They took money from a consumer, etc.

Without their "kindness" or "favours" or the ZACR doing the Registrant
a "favour" 

A domain update would not be possible.

So, imnsho not only is the attitude of the ZACR EVIL/WRONG 

so is the attitude of the losing Registrar in ignoring the consumer,
whom they took money from.

Anyway, if there was no "favour" done - this would now be a court case
- and it will be interesting to see who would have been awarded costs
  in this matter...
