Dear Breck,

Both names were validly published. The species Ortega named Agave scabra was a completely different one from which Salm-Dyck named Agave scabra. So Agave scabra Salm-Dyck requires a different name of which the earliest available is Agave asperrima Jacobi. There is no reason to conserve Agave scabra Salm-Dyck because the name had been used only relatively recently and the species is again being called Agave asperrima Jacobi in the most recent literature.

  Steve, sorry, I don't understand all this yet.  Are you saying that Ortega's 
  naming of this agave was not legitimate?  And if so, then why couldn't 
  Salm-Dyck describe it with the same name, since the name scabra was not 
  legitimately published?  (In effect Salm-Dyck would have then been 
  describing the entity for the first time).  Regardless, it seems to me that 
  Agave scacra is a prime candidate for a nomen conserv.  BB
