You are missing absolutely nothing.

It is short sightedness on the part of the CRTC.  They should have
mandated that all ISPs are merely pipes (check the archives about 5 years
back if you want pages where I debated the pro of this).

One way to easily handle this, would be to force very strict separation
between ISP and backbone, even if run by the same company.  Another would
be to ensure a hands off approach as well.

ISPs need to be merely pipes.  All of the bandwidth shaping, excessive
blocking of ports, take down notices, censorship by corporate zealots, has
all been the result of the silly thought that an ISP is more than a pipe.

Of course, it is only starting.  If things do not change soon, the
internet of a few years from now will be a much less useful, much more
corporate, and a much more controlled thing.
